Terms of Service

Subscription Agreement

"By creating a workspace or embedding Qrpoll survey widgets, you agree to comply with these terms. Please review our service definitions, subscription terms, and review routing guidelines carefully."

These Terms of Service ("Terms") govern access to and use of the Qrpoll reputation management and offline review funnels platform. By signing up, you represent that you have legal authority to bind your business entity or agency.

1. Acceptance of Terms

By registering an account or deploying our QR code funnels, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the platform immediately.

2. Description of Service

Qrpoll is an offline-to-online reputation management SaaS providing:

  • Dynamic QR survey generators for physical venues (tables, counters, receipts).
  • Automated star rating review routing to public platforms (Google Maps, Yelp, TripAdvisor).
  • Private internal complaint capture forms to resolve negative customer experiences internally.
  • Lead generation and offline CRM data collection (guest email, phone, voucher delivery).
  • Multi-location workspace management and Agency Partner white-label tools.

3. Smart Review Routing & Compliance

Qrpoll provides customizable routing logic that directs satisfied guests (e.g. 4–5 stars) to public review profiles while inviting unsatisfied guests (e.g. 1–3 stars) to submit private feedback to management.

Merchant Compliance Obligation

You acknowledge that major review platforms (such as Google, Yelp, and TripAdvisor) and local consumer protection authorities have guidelines regarding review collection and gating. You are solely responsible for ensuring that your review collection campaigns, promotional incentives, and venue policies comply with applicable platform rules and local advertising laws.

4. User Accounts & Security

  • You must maintain the confidentiality of your workspace login credentials.
  • You are responsible for all activity conducted through your account by team members or sub-accounts.
  • You agree to notify us immediately of any unauthorized access or security breaches.

5. Subscriptions & Merchant of Record

Qrpoll offers a Starter Free tier alongside premium recurring tiers (Reputation Growth at $99/mo and Agency Partner at $299/mo) with optional annual discount billing:

International Payments (Lemon Squeezy)

For all non-VND billing, Lemon Squeezy acts as the Merchant of Record, handling checkout, invoicing, VAT/sales tax collection, and recurring payment processing.

Domestic Vietnamese Payments (PayOS)

For local payments in Vietnam, transactions are handled via PayOS instant bank transfer QR integration.

Auto-Renewal & Cancellation

Subscriptions renew automatically at the end of each billing cycle unless canceled prior to the renewal date via your workspace dashboard. Access remains active through the end of the paid period.

6. Refund Policy

EU / EEA Consumers: Under EU consumer protection regulations, subscribers within the European Economic Area have the statutory right to cancel and receive a full refund within 14 days of initial subscription purchase without penalty.

Standard Refund Policy: For business clients worldwide, if technical issues prevent normal usage of our QR routing engine, please contact us within 7 days of purchase. Refunds are reviewed on a case-by-case basis.

7. Acceptable Use Policy

You agree NOT to use Qrpoll to:

  • Execute review extortion schemes or solicit fabricated fraudulent reviews.
  • Transmit phishing URLs, malware, or deceptive redirect links to unsuspecting guests.
  • Harass customers who submit low ratings or submit unrequested spam SMS/emails.
  • Violate the intellectual property rights of any third-party review platforms.

8. Limitation of Liability

Qrpoll is provided "AS IS" without warranties of any kind. We are not liable for any ranking changes, algorithmic demotions, or profile suspensions imposed by third-party review networks (Google, Yelp). In no event shall our total liability exceed the subscription fees paid by you in the 3 months preceding the event.

9. Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of Vietnam, without giving effect to conflict of law principles.
